General Conditions of Sale
This document contains the General Conditions of Sale that govern the offer and sale of “Pasta Paisanella” brand products ( “Products”), as defined below, through the e-commerce site www.pastapaisanella.com (hereinafter the “Site”), owned by Studio Pasta srl - unipersonale via Pietro Capasso, 27 84134 Salerno.
Studio Pasta deals with the sale of Products through the Site. Purchases of Products made through the Site will see as parties Studio Pasta, as Seller, and the person who proceeds with the purchase of one or more Products for purposes not related to their entrepreneurial, commercial, artisanal or professional activity, as buyer (hereinafter the “Consumer/s”), (Seller and Consumer will be collectively referred to as the “Parties”).
These General Conditions of Sale apply to the offer of Products, as defined below, to Consumers, where Consumers are understood to be:
natural persons who act for purposes not related to any commercial or professional activity they may carry out, as well as to the forwarding and acceptance of online purchase orders between the Seller and a consumer (commercial relationships known as Business to Consumer or B2C). Therefore, the provisions contained in Legislative Decree no. 206/2005, known as “Consumer” apply. Consumer Code, and in Legislative Decree no. 70/2003 on electronic commerce;
natural persons acting for purposes related to the commercial or professional activity carried out regarding the offer, forwarding and acceptance of online purchase orders between the seller and a single company (commercial relationships known as Business to Business or B2B) and not for personal reasons (pursuant to Article 3, paragraph 1, letter b, of Legislative Decree no. 206/2005 - the so-called Consumer Code). Furthermore, the provisions contained in the civil code, in Legislative Decree no. 70/2003 on electronic commerce and in Legislative Decree no. 206/2005, the Consumer Code, where also extended to B2B relationships, apply. The Seller invites you to carefully read these General Conditions of Sale before making any purchase through the Site. The Seller, in fact, reserves the right to modify these General Conditions of Sale at any time it deems appropriate; any new rules will be effective from their publication on the Site and will apply to sales that will be made starting from their publication.
For further information, you can contact the Seller who will respond from Italy via the Contact form that you will find on the Site (contact with the Seller through these methods is defined, hereinafter, as "Customer Service").
The Products on the Site are intended for an adult audience. The Seller declines all responsibility deriving from any purchase of the products made by minors.
The Owner is not a party to these general conditions of sale, but is the owner of the rights to the domain name of the Site, the logos and trademarks, relating to the products presented on the Site, as well as the copyright on the contents of the Site.
Any communication from the Consumer connected and/or related to the purchase of the Products - including any reports, complaints, requests concerning the purchase and/or delivery of the Products, the exercise of the right of withdrawal, etc. - must be sent to the Seller at the addresses and according to the methods indicated on the Site.
In the case of payment by credit card, the entire payment procedure will be managed, in absolute safety by WORLDLINE, while the Seller will not come into possession of any information relating to the complete number of the credit/debit card, the security code, or similar.
Shipping and delivery of Products
The Seller ships the Products in Italy and abroad via primary express couriers. Delivery will take place from Monday to Friday based on the conditions signed at the time of formalizing the order.
The countries to which the Seller ships are those belonging to the EU, indicated on the "Shipping" service page.
The Seller undertakes to do everything necessary to respect the delivery times indicated above, but cannot in any case be held responsible for damages or inconveniences caused by any delays.
For this initiative, shipping costs will be indicated and visible on the cart page before making the purchase.
Always check the number and integrity of the packages at the time of delivery. Verify the conformity of the Product delivered to you with the order placed and carry out the procedure indicated in point 5.4 of these General Conditions of Sale. Only after verification, you can sign the delivery documents unless you obviously take advantage of the right of withdrawal as provided for in article 8 of these General Conditions of Sale.
In the event of anomalies or damage, the complaint must be made immediately to the courier, refusing delivery and promptly reporting the incident to Customer Service, as specified in Article 5 of these General Conditions of Sale. The costs of re-delivery will be entirely borne by the Seller.
Delivery by express shipping is intended to be at street level and will be carried out, unless otherwise indicated, from Monday to Friday during normal office hours (from 9:00 to 18:00), excluding national holidays.
If on the day of delivery, You are not available at the address indicated by You, 1 further delivery attempts will be made and if they are not successful, the goods will be returned to our warehouse.
